("Supercell," "we," "us," or "our"), governing your access to and use of the supercelluk.com website and the Supercell hotel operations platform (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use the Service.
Supercell provides a cloud-based hotel operations automation platform that enables hospitality businesses to manage cleaning schedules, maintenance workflows, guest communications, digital guest guides, and operational analytics. The Service is provided on a subscription basis as described in our pricing page.

Access to the Service requires a paid subscription after the initial 14-day free trial period. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page. All fees are exclusive of taxes, which will be applied where required by law. Payments are processed through our third-party payment processor and are non-refundable except as expressly stated herein.
We offer a 14-day free trial of our Professional plan features. No credit card is required to start a free trial. At the end of the trial period, you may choose to subscribe to a paid plan or your account will be converted to a limited free tier.

The Service and its original content, features, and functionality are owned by Supercell Technologies Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
You retain all rights to the data you submit to the Service ("User Data"). By using the Service, you grant us a limited license to use, process, and store your User Data solely for the purpose of providing the Service. We will handle your User Data in accordance with our Privacy Policy.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may export your data within 30 days of account termination by contacting our support team.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
IN NO EVENT SHALL SUPERCELL TECHNOLOGIES INC., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Denver County, Colorado.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
